AREA, ROADS, and TRAILS RESTRICTION ORDER

Pursuant to 16 U.S.C. §551, and 36 C.F.R. §261.50(a) and §261.50(b), the following restrictions are in effect on all National Forest System lands within the area described below, and on certain Forest System roads and trails as described below, on the Hungry Horse-Glacier View Ranger District on the Flathead National Forest, Flathead County, Montana.

PROHIBITION

36 CFR §261.52(e) It is prohibited to go into or be upon the area described below.

36 CFR §261.54(e) Being on the road is prohibited. The following Forest System Roads (FSR’s) or potions of FSR’s are closed to all wheeled, motorized, and foot traffic: #115, #210C, #376, #5241, as further described below.

36 CFR §261.55(a) Being on the trail. The following system trails or potions of system trails are closed to all wheeled, motorized, and foot traffic:#2, #3, #9, #14, #26, and #40 as further described below.

PURPOSE

This restriction is for public health and safety due to the active Hay Creek Fire.

AREA CLOSED

Hay Creek Fire closure area as shown as the black hash-marked polygon on the attached map (Exhibit A). The western boundary of the closure is trail #26 between its junction with trail #14 and FSR #115, FSR #115 between trail #26 and the west side of T35N, R23W Section 23, the west side of T35N, R23W Sections 23, 14, and 11 until it meets trail #9. The northern boundary is trail #9 where it leaves the west side of T35N, R23W Section 11 east to FSR # 210C and FSR #210C. The southern boundary is trail #14 and the Forest boundary with Coal Creek State Forest to the North Fork Road. The eastern boundary is composed of the National Forest boundaries with private land west of the North Fork Road between FSR #210C and FSR #376.

ROADS CLOSED

The following National Forest System Roads, as shown in Exhibit A.

  • Red Meadow Road #115 from its terminus with the North Fork Road to its junction with FSR #
  • Moose Creek Road #210C
  • Hay Creek Road #376 from its junction with FSR #909 to its terminus to the
  • Cyclone Creek – Moran Creek Road #909
  • Moran Basin Road #5241.

TRAILS CLOSED

The following National Forest System Trails, as shown in Exhibit A.

  • Moran Creek Trail #
  • Hay Creek Trail #3 Trail (Part of the Pacific Northwest National Scenic Trail)
  • Moose Creek Trail #9 from FSR #210C to the west side of T35N, R23W Section 11
  • Coal Ridge Trail #14
  • Whitefish Divide Trail #26 (Part of the Ralph Thayer National Recreation Trail) from its terminus with FSR #115 to its junction with trail#14.
  • Cyclone Lookout Trail #40

IMPLEMENTATION

This order will be in effect from July 27, 2021 to December 1st, 2021 or until rescinded, whichever comes first.These prohibitions are in addition to the general prohibitions in 36 C.F.R. Part 261, Subpart A

EXEMPTIONS

Pursuant to 36 C.F.R. §261.50(e), the following are exempt from this Order:

  1. Persons with a special use authorization or other Forest Service authorization specifically exempting them from the effect of this 36

C.F.R. § 261.50(e)(1).

  1. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official 36 C.F.R. §261.50(e)(4)

PENALTY

Violation of these prohibitions is punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization, or imprisonment fornot more than 6 months, or both (16 U.S.C. § 551 and 18 U.S.C. §§ 3559, 3571, and 3581).
