National Forest System Area and Trail Closure-Black Mountain and Trail Creek Fire

Pursuant to 16 U.S.C. § 551, 36 C.F.R. § 261.50 (a) and (b) the following acts are prohibited on the Dillon and Wisdom Ranger District, Beaverhead-Deerlodge National Forest and the North Fork Ranger District, Salmon- Challis National Forest.PROHIBITION:1. To go into or be upon the area described below [36 C.F.R. § 261.52(e)].2. Being on the trails described below [36 C.F.R. § 261.55(a)].

AREA CLOSURE DESCRIPTION: The closure applies to all National Forest System (NFS) lands, including road and trails depicted on the attached map (Attachment A). The boundary of the area closure is generally described as beginning at the corner of the Beaverhead-Deerlodge NF Boundary in T4S R17W Sec 25 and follows the FS Boundary southerly to T7S R15W Sec 24, then easterly and northerly to T6S R13W Sec 22, then southerly to T9S R14W Sec 16, then continues westerly to T9S R15W Sec 16 and the junction to the Montana-Idaho State Boundary. Closure then continues northerly, along the Beaverhead-Deerlodge NF Boundary and Montana State line to T4S R18W Sec 36, then easterly along section line to FS Trail No 3376, it then follows FS Trail No 3376 easterly to its junction with the FS boundary, and then follows the FS Boundary southerly to start at T4S R17W Sec 25.

TRAIL CLOSURE DESCRIPTION:  For clarity, it is specifically noted here that the following trail segments, which are located entirely within the Closure Area described above, are closed:The Continental Divide Trail (CDT) on the Beaverhead-Deerlodge and Salmon-Challis National Forests is closed from the Montana-Idaho Border starting approximately 6 miles North of Lemhi Pass on the Montana side: T9S R15W Sec 21; (Idaho side: T20N R25E Sec 26) to the Montana-Idaho Border at T3S R18W Sec 34. The Nez Perce National Historic Trail (NPNHT) will be closed beginning at the Forest Boundary in T9S R15W Sec 14 (Bloody Dick Creek Rd, BD Road 181) and continues northerly to the Forest Boundary in T7S R15W Sec 4 (Skinner Meadows Rd, BD Road 381) and is depicted on the attached map (Attachment A).

PURPOSE:  This closure is for public health and safety due to the Black Mountain and Trail Creek Fire.Order Number 2021-D1/D3-015

This order will be in effect from July 19, 2021, and shall remain in effect until September 01, 2021, or until the order is rescinded, whichever occurs first. These prohibitions are in addition to the general prohibitions in 36 C.F.R. Part 261, Subpart A.

EXEMPTIONS:  Pursuant to 36 CFR 261.50(e), the following persons are exempt from this Order:(1) Persons with a Forest Service special use authorization or other authorization specifically exempting them from the effect of this Order;(2) Owners or lessees of land in the closure area;(3) Residents in the closure area;(4) Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty; and

VIOLATION: Violation of these prohibitions is punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization, imprisonment for not more than 6 months, or both. (16 U.S.C. §551 and 18 U.S.C. §§ 3559, 3571(b)(6) and 3581(b)(7).
