FOREST ORDER

National Forest System Area, Trail and Road Closure – Trail Creek Fire

Pursuant to 16 U.S.C. § 551, 36 C.F.R. § 261.50 (a) and 36 C.F.R. § 261.52 (e) the following acts are prohibited on the Wisdom Ranger District, Beaverhead-Deerlodge National Forest and the North Fork Ranger District of the Salmon-Challis National Forest

PROHIBITION:

1. To go into or be upon the area described below [36 C.F.R. § 261.52(e)].

PURPOSE:

This closure is for public health and safety due to the Trail Creek Fire.

AREA CLOSURE DESCRIPTION:

The closure applies to all National Forest System (NFS) lands, including roads and trails (including the Continental Divide Trail), depicted on the attached map (Attachment A). The boundary of the area closure is generally described as beginning at the junction of Beaverhead-Deerlodge National Forest boundary with the Salmon-Challis National Forest boundary (on the state border between Montana and Idaho) in T2S R18W sec 34, following the Continental Divide Trail Northwest to Chief Joseph Pass at T2SR19W sec 11, from there continuing Northeast and then South along the Continental Divide Trail to T1S R18W sec 9, then South following Trail 3062 to Road 1210 and then to Road 1210A, continuing south to the end of Road 1210A, then turning Southwest on Hwy 43 at T2S R18W sec 13, and continuing to and including May Creek Campground, then following Trail 3102 to T3S R18W sec 35, then due West to the point of beginning in T2S R18W sec 34.

Additionally, the Continental Divide Trail on the Beaverhead-Deerlodge and Salmon-Challis National Forests is closed from the Montana Idaho border starting at T2S R18W sec 34 going Northwest to Chief Joseph Pass at T2SR19W sec 11, and continuing Northeast to T1S R18W sec 9 , where the trail intersects with Trail 3062.

IMPLEMENTATION:

This order will be in effect from July 10, 2021, and shall remain in effect until August 01, 2021, or until the order is rescinded, whichever occurs first.

These prohibitions are in addition to the general prohibitions in 36 C.F.R. Part 261, Subpart A.

Pursuant to 36 CFR 261.50(e), the following persons are exempt from this Order:

(1) Persons with a Forest Service special use authorization or other authorization specifically exempting them from the effect of this Order.

(2) Owners or lessees of land in the area;

(3) Residents in the area;

(4) Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty; and

VIOLATION:

Violation of these prohibitions is punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization, imprisonment for not more than 6 months, or both. (16 U.S.C. §551 and 18 U.S.C. §§ 3559, 3571(b)(6) and 3581(b)(7).
