UNITED STATES DEPARTMENT OF AGRICULTURE FOREST SERVICE TONTO NATIONAL FOREST GLOBE, TONTO BASIN AND MESA RANGER DISTRICTS Woodbury Fire Public Safety Closure Order PROHIBITIONS

Pursuant to 16 U.S.C. § 551 and 36 C.F.R. § 261.50(a), the following acts are prohibited on all National Forest System lands as described in this Order (the “Restricted Area”), and as depicted on the attached map, hereby incorporated into this Order as Exhibit A, all within the Tonto National Forest, within the state of Arizona.

  1. Going into or being upon the Restricted Area. 36 C.F.R. § 261.53(e).

EXEMPTIONS

Pursuant to 36 C.F.R. § 261.50(e), the following persons are exempt from the provisions of this Order:

  1. Any Federal, State, or local officer, or member of any organized rescue or fire fighting force in the performance of an official duty.

  2. Persons engaged in a business, trade, or occupation in the Restricted Area, who are authorized to be in the Restricted Area by the US Forest Service, the state of Arizona, or the counties of Gila, Maricopa or Pinal, and their employees, agents, contractors and subcontractors.

  3. Residents using roads in the Restricted Area to the extent necessary to access their private property.

RESTRICTED AREA

Unless otherwise noted below, the Restricted Area encompasses all National Forest System lands, roads and trails within the boundary starting at National Forest System Road (NFSR) 357 and the Tonto National Forest (NF) boundary, then following north along the NF boundary for approximately 8 miles, then following west for approximately 5 miles to Peralta Trailhead, then following in a general northwesterly direction for approximately 9 miles along Trails 235, 234, 104, and 103, then following Trail 236 southwest for 3 miles to the Wilderness Boundary at First Water Trailhead, then following north along the Wilderness Boundary for 5 miles to Highway 88, then following east along the southern edge of Highway 88 for approximately 10 miles to the Fish Creek Vista, then crossing to the north side of Highway 88 and following the north side of Highway 88 for approximately 6 miles to the Apache Lake Vista, then crossing back to the south side of Highway 88, then following the south side of Highway 88 to the junction with Highway 188, then following southeast along the western edge of Highway 188 for approximately 22 miles to the intersection with private property (approximately the southwest corner of Section 4, T. 1 N, Range 15E), then following the NF/private property boundary line briefly west, then south, then west, then south, then east, until the junction of the boundary line with the northern edge of US Highway 60, then following southwest along US 60 for approximately 21 miles to the junction with the NF boundary just north of Dromedary Peak (T. 2S, R. 11E., Sec. 18), then following the NF boundary north, then west, back to the starting point at the intersection of NFSR 357 and the Tonto NF boundary.

Note: US Highway 60 and State Highway 188 are open; State Highway 88 is only closed from Fish Creek Overlook at milepost 220 to Apache Lake Vista at milepost 228. All private properties shown in white on Exhibit A are not part of the Restricted Area.

PURPOSE

The purpose of this Order is to protect National Forest visitor health and safety and firefighter health and safety, by eliminating the potential for members of the general public to enter into the Woodbury Fire planning area while wildland fire suppression and emergency operations are taking place.

IMPLEMENTATION

  1. This Order will be in effect at 06:00 a.m. on July 30, 2019, and shall remain in effect until September 30, 2019 or until rescinded, whichever occurs first.

  2. A map identifying the Restricted Area is attached and made part of this Order as Exhibit A.

  3. Any violation of this prohibition is punishable as a Class B misdemeanor by a fine of not more than $5,000 for individuals or $10,000 for organizations, or by imprisonment for not more than six (6) months, or both (see 16 U.S.C. 551, 18 U.S.C. 3571(b)(6), 18 U.S.C. 3581(b)(7)).

  5. This Order supersedes any previous Order prohibiting the same acts covered by this Order, particularly Woodbury Fire Public Safety Closure Order Number: 03-12-00-19-356.
