TRAIL RESTRICTION ORDER


Cardinal Peak Divide # 136, Cabin Creek #205, Pilot Peak #128, Cardinal Creek #506, Young’s Creek #141, Hahn Creek #125, Hahn Creek Cut-across #124, Otter Creek #279 and Blackfoot Divide #278 are closed due to fire behavior.



Pursuant to Title 36 Code of Federal Regulation 261.50 (b), the following restriction is in effect on the Spotted Bear Ranger District on the Flathead National Forest, Flathead County, Montana. This temporary restriction is in addition to those enumerated in Subpart A, Part 261, Title 36, Code of Federal Regulations. These restrictions become effective when signed and will remain in effect until rescinded. See the attached map, Exhibit A.

Being on the trail [Title 36 CFR 261.55(a)]

The below listed National Forest System Trails located on the Spotted Bear Ranger District are closed to all public travel because of wildfire activity associated with the Reef Fire.



Description of Restricted National Forest Access



Trail #136, in its entirety, from the junction with Pilot Peak Trail #128 (NW ¼ of Section 10, R 13W, T 19N) to its terminus (SE ¼ of Section 19, R 14W, T 19N).


Trail #205, in its entirety, from the junction with Young Creek Trail #141 (SE ¼ of Section 28, R 13W, T 19N) to the junction with Cardinal Peak Divide Trail #136 (SW ¼ of Section 13, R 14W, T 19N).


Trail #128, in its entirety, from the junction with Hahn Creek Trail #125 (NE ¼ of Section 26, R 13W, T 20N) to the junction with Cardinal Peak Divide Trail #136 (NW ¼ of Section 10, R 13W, T 19N).


Trail #506, in its entirety, from the junction with Holland - Gordon Trail #35 (SE ¼ of Section 10, R 14W, T 19N) to the junction with Cardinal Peak Divide Trail #136 (NE ¼ of Section 28, R 14W, T 19N).


Trail # 141, in its entirety, from the junction with Hahn Creek trail #125 (NW ¼ of section 23, R 13W, T 19N) to its terminus at Youngs Pass (SE ¼ of Section 4, R 13W, T 17N).


Trail #125, from the junction with the Youngs Creek Trail Ford (NW ¼ of section 31, R 12W, T 20N) to its terminus at Hahn Creek Pass (SE ¼ of section 13, R 12W, T 18N).


Trail #124, in its entirety from the junction with Hahn Creek trail #125 (SE ¼ of section 23, R 13W, T 19N) to its terminus at the junction with Youngs Creek Trail #141 (NE ¼ of section 28, R 13W, T 19N).


Trail #279, in its entirety from the junction with the Hahn Creek Cut-off Trail #124 (SE ¼ of section 22, R 13W, T 19N) to its terminus with the Blackfoot Divide Trail #278 (SE ¼ of section 15, R 13W, T 18N).


Trail #278
, in its entirety from the junction with the Dunham Creek Trail #400 (NW ¼ of section 20, R 13W, T 17N) to its terminus at Hahn Creek Pass (SE ¼ of section 13, R 12W, T 18N).


Exemptions:


Pursuant to Title 36 CFR 261.50(e), the following are exempt from this restriction:


1. Persons with a permit issued by a forest officer specifically authorizing the otherwise prohibited act or omission.


2. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.

Penalty: Violation of these prohibitions is punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization, or imprisonment for not more than 6 months, or both (16 USC 551 and 18 USC 3559 and 3571).


Notification: A copy of this order shall be posted as prescribed in 36 CFR 261.51.
