ORDER NO. 14-05-758

KLAMATH NATIONAL FOREST

EMERGENCY CLOSURE

Pursuant to 16 USC 551 and 36 CFR 261.50(a) and (b), and to provide for public safety, the following acts are prohibited within the Klamath National Forest. This Order is effective from September 18, 2014, until the Whites Fire is declared out.

1. Going into or being upon National Forest System lands within the Whites Fire Closure Area. The boundary of the Whites Fire Closure Area begins at the intersection of the Pacific Crest Trail (Forest Trail No. 2000) and the boundary of the Marble Mountain Wilderness; then continues east and then southeast along the western edge of the Pacific Crest Trail (Forest Trail No. 2000) to its intersection with the boundary of the Russian Wilderness; then continues southeast and then southwest along the boundary of the Russian Wilderness to its intersection with Deacon Lee Trail (Forest Trail No. 5436); then continues west along the southern edge of Deacon Lee Trail (Forest Trail No. 5436) to its intersection with Deacon Lee Road (Forest Road No. 39N58); then continues west along the southern edge of Deacon Lee Road (Forest Road No. 39N58) to its intersection with Grasshopper Picayune Road (Forest Road No. 39); then continues west and then northwest along the northern and eastern edge of Grasshopper Picayune Road (Forest Road No. 39) to its intersection with Black Bear Summit Road (Forest Road No. 39N60); then continues northeast along the southeastern edge of Black Bear Summit Road (Forest Road No. 39N60) to its intersection with Orin E. Lewis Road (Forest Road No. 39N27); then continues north and then south along the eastern and then western edge of Orin E. Lewis Road (Forest Road No. 39N27) to its intersection with Eddys Gulch Road (County Road No. SIS-2E001); then continues north along the eastern edge of Eddys Gulch Road (County Road No. SIS-2E001) to its intersection with Sawyers Bar Road (County Road No. SIS-1C01); then continues west along the northern edge of Sawyers Bar Road (County Road No. SIS-1C01) to its intersection with Jackass Gulch Trail (Forest Trail No. 5444); then continues north along the eastern edge of Jackass Gulch Trail (Forest Trail No. 5444) to its terminus; then continues due north to its intersection with the boundary of the Marble Mountain Wilderness; then continues northeast along the boundary of the Marble Mountain Wilderness back to the starting point, as shown on the attached map. 36 CFR 261.53(e).

2. Being on any National Forest System road in the Whites Fire Closure Area, as shown on the attached map.36 CFR 261.54(e).

3. Being on any National Forest System trail within the Whites Fire Closure Area, as shown on the attached map. 36 CFR 261.55(a).

Pursuant to 36 CFR 261.50(e), the following persons are exempt from this Order:

1. Persons with a permit from the Forest Service specifically authorizing the otherwise prohibited act or omission.

2. Any Federal, State, or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.

3. Owners or lessees of private land in the Whites Fire Closure Area to the extent necessary to gain access to their land.

These prohibitions are in addition to the general prohibitions in 36 CFR Part 261, Subpart A.

A violation of these prohibitions is punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization, or imprisonment for not more than six months, or both. 16 USC 551 and 18 USC 3559, 3571, and 3581.
