PROHIBITIONS

 

Pursuant to 16 U.S.C. § 551 and 36 C.F.R. § 261.50 (a), the following is prohibited on the National Forest System (NFS) lands in the Wisdom Ranger District, Beaverhead­ Deerlodge National Forest, described below and shown on the attached map incorporated into this Order as Exhibit A (the "Described Area):

 

Going into or being upon the area described below. 36 C.F.R. § 261.53 (e).

 

EXEMPTIONS

 

Pursuant to 36 C.F.R. § 261.50(e), the following persons are exempt from this Order:

 

1.      Any Federal, State, or Local Officer, or member of an organized rescue or firefighting resource in the performance of an official duty.

 

2.      Persons with a Forest Service special use authorization or other authorization specifically exempting them from the effect of this Order.

 

DESCRIBED AREA/ROADS/TRAILS

 

The Described Area is all NFS lands, roads and trails within the boundary starting in the NE¼ of the SW¼ of Section 14 in T1S R19W at the junction of FS Road 106 and CONST Trail 9 (Gibbons Pass Trailhead); then continuing southeasterly on FS road 106 (for approximately six miles) to the junction of FS road 106 and FS Road 1297 in the SW¼ of the SE¼ of Section 4 in T2S R18W; then following the section line, due east two miles, to where this section line intersects with FS road 1085 in the SE¼ of the SE¼ of Section 2 in T2S R18W; then following the FS road 1085, in an easterly direction, to the FS road 1085 and FS 1203 junction in the NE¼ of the NW¼ of Section 10 in T2S R17W; then continuing northerly on FS road 1203 to the junction of FS road 1203 and FS road 1137 in the SE¼ of the SE¼ of Section 15 in T2S R17W; then following FS road 1203 in a northeasterly direction to the SE¼ of the SE¼ of Section 1 in T2S R17W; then in an easterly direction, for a half mile, to the SW¼ of the SE¼ of Section 6 T2S R16W; then


heading north, for two miles, to the junction of FS Trail 3372 in the NW¼ of the SW¼ Section 29 T1N R16W; then heading west to the junction of FS trail 3372 and FS trail 3379 in the SW¼ of the NE¼ Section 30 T1N R16W; then following FS trail 3372 to the junction of FS trail 3372 and CONST Trail 9 of the NE¼ of NE¼ Section 18 T1NR16W; then following the CONST Trail 9, in a southwesterly direction, to the starting point in the NE¼ of the SW¼ of Section 14 in T1S R19W at the junction of FS Road 106 CONST and Trail 9 (Gibbons Pass Trailhead).

 

PURPOSE

 

The purpose of this Order is to ensure public health and safety during fire suppression efforts of the Trail Ridge Fire.

 

IMPLEMENTATION

 

1.      This Order shall be in effect from September 8, 2022 at 0600 until rescinded or until October 31, 2022 at 0001, whichever occurs first.

Unless otherwise expressly defined in this Order, the terms used in this Order are defined by the regulations of the Secretary of Agriculture, 36 C.F.R. Chapter 11, Parts 200-,299. If there are terms in this Order that are not expressly defined in the Order or 36 C.F.R. Chapter 11, Parts 200-299, their meaning shall be determined by their plain language definitions.

 

A violation of the above prohibitions is punishable as a Class B misdemeanor by a fine of not more than $5,000 for individuals and $10,000 for organizations, or by imprisonment for not more than six months, or both. 16 U.S.C. § 551; 18 U.S.C.

§§ 3559, 3571, and 3581.
